浅析市场经济建设中集团诉讼制度的确立

• 摘要： 伴随着我国市场经济的高速发展，经济性侵权行为无处不在，由此引发的群体纠纷大量发生，但由于企业社会责任及诉讼程序法律制度的缺失，这类经济侵权行为未能得到及时制止，社会整体利益的保护缺乏有效的救济渠道。而集团诉讼制度与市场经济的发展恰恰存在价值取向上的制度性契合，集团诉讼不仅能够有效地遏制强势经济主体的侵权行为，而且也能够有效地保护弱势群体的合法权益并维护市场经济秩序，所以在建设市场经济过程中，结合中国国情，借鉴完善集团诉讼制度在我国市场经济领域的适用具有现实的必要性。
• Along with the rapid development of our country’s market economy,the economic tort is everywhere, the resulting group disputes take place in alarge number, but because of corporate social responsibility and the lack of thelegal system of the litigation procedure, this kind of economic tort can not bestopped in time, the protection of the social whole interests lacks effective reliefchannels. However, the system of class action suits the development of marketeconomy precisely in terms of value orientation. Class action suits can not onlyeffectively curb the torts of strong economic entities, but also effectively protectthe legitimate rights and interests of vulnerable groups and maintain the orderof market economy. Therefore, in the process of building market economy,combined with China’s national conditions, It is necessary to improve theapplication of the class action system in the market economy of our country.
