论多道心理生理测试的鉴定执业分类 ——基于《法医类司法鉴定执业分类规定》的思考

- Abstract: The Ministry of Justice has published Provisions on the Classification of Forensic Expertise in Forensic Medicine lately. This document incorporated Polygraph Testing into forensic considerations in judicial authentication, which helps to legitimate the use of Polygraph Testing results as evidence, promote theoretical research on using assessment results authenticating documents, and regulate assessment process and professional qualification licensing. However, the definition of testing in this document is inconsistent with the current practice of Polygraph Testing in China, and the particularity of testing different from psychiatric identification is not considered, which is not conducive to the sustainable development of the testing industry.司法部 2020 年 5 月颁布的《法医类司法鉴定执业分类规定》，将多道心理生理测试纳 入司法鉴定中的法医精神病类，有助于从法律上明确测试结论作为证据的合法性；促进测试结 论作为鉴定意见的基础理论研究；规范测试程序和职业准入资格。但《规定》对测试的界定与 我国多道心理生理测试执业现状不符，也未考虑测试区别于精神病类鉴定的特殊性，对测试行 为可持续发展形成巨大挑战。
