• 摘要： 国际习惯和一国内部的“公共秩序”，需要国际法各类关系主体予以 尊重。在国际习惯之中，违反强行法和国际习惯，都是导致条约或者国际法非 法的典型因素。而文化传统，指导一个国家的国民思维，进而影响国家行为和 判断，成为现有国际法存在发展过程之中无法回避的一个客观因素，直接影响 到一个国家国际法价值观的形成。
• International customs and the “public order” within a country need to be respected by all kinds of subjects of international law. Among international customs, violation of jus cogens and international customs are typical factors leading to illegality of treaties or international laws. The cultural tradition, which guides the national thinking of a country, and then affects the behavior and judgment of the state, has become an objective factor in the process of the existence and development of the existing international law, and has a direct impact on the formation of a country’s values of international law.
