浅析民间彩礼返还涉及的法律问题
Analysis of the Legal Issues Involved in the Return of Folk Betrothal Gifts

- Abstract: Betrothal ceremony, as a traditional folk marriage custom in China, has a long history and has been continued up to now. Especially in some remote rural areas in China, the economic development is relatively backward, and the occurrence of betrothal disputes is more common. In this case, China has only issued the interpretation of the Supreme People's Court on Several Issues concerning the application of the marriage law of the people's Republic of China (II), which provides a legal basis for the settlement of the problem of betrothal gifts return. However, due to the provisions of the judicial interpretation is too general, resulting in a variety of disputes. Therefore, the author makes a brief analysis from the overview, legal attributes and legal problems in practice, and puts forward suggestions on improving the legal regulation of betrothal gifts return. 彩礼作为我国的传统民间婚嫁习俗,具有很长的历史并一直延续至今,尤其在我国一些偏远农村地区,经济发展相对落后,彩礼纠纷的发生更是屡见不鲜、司空见惯。在这种情况下,我国目前只出台了《最高人民法院关于适用<中华人民共和国婚姻法>若干问题的解释(二)》,该司法解释为彩礼返还问题的解决提供了法律依据。但由于该司法解释的规定过于笼统导致各种纠纷问题的出现。因此，笔者从彩礼的概述、法律属性以及实践中出现的法律问题等角度作了简要分析，据此提出完善彩礼返还法律规制的建议。
