  • 摘要: 无因管理制度是道德入法的典型体现,无因管理制度将协调 “私权神圣”的法律原则与“倡导人类互助”的道德原则作为其规范的基点,自罗马法以降,无因管理制度历经变革,但其实现社会和谐与法律公正之终极目标从未更改。因无因管理行为乃缘起管理人单方之事实行为,故而较其他法律制度,无因管理之制度设计更加偏重于对管理人行为的规制,既要提倡助人,又要防止损人,但何为助人又该怎样助人,何为损人又产生怎样后果,法律之评判尺度在此具有了更加重大的道德意义与现实意义。
  • Negotiorum management system is a typical embodiment of morality into the law. It takes the legal principle of "sanctity of private rights" and the moral principle of "advocating mutual assistance of human beings" as its standard base point. Since Roman law, the system has undergone changes, but its ultimate goal of achieving social harmony and legal justice has never changed. Because negotiorum management is caused by the fact that the manager acts unilaterally, the system design of negotiorum management focuses more on the regulation of the manager's behavior than other legal systems. It not only advocates helping others, but also prevents harming others, but also has more important moral significance and significance in this regard Real meaning.
