• 摘要： 随着司法体制改革的逐步深入，审判权力运行机制将发生一些结构性的改变，加上法官员额制的全面落实推进，与之俱来的则是司法责任风险点随着法官岗位的不同发生变化和转移。为了适应这些因司法体制改革带来的变化，建立一个科学有序的审判和执行权力运行机制，就必须结合当前司法改革的背景，充分利用信息化时代带来的智能化手段及科学化管理，针对司法体制改革后不同法官岗位的风险特点，因岗制宜，因人施策，灵活应对，加快新型法官岗位风险防控模型研究，推动建立和完善人民法院的风险防控体系。本文是基于对近几年法官犯罪情况的实证分析，充分认识到在司法体制深入改革的背景之下，建立新型法官岗位风险化解与防控体系的现实必要性，通过认真梳理法官岗位风险的种类，借助信息化大平台提供的大数据及智能化手段来探究构建新型法官岗位风险化解与防控体系的总体思路及具体路径，从而有效应对司法责任风险点的改变，推进司法审判执行权力健康有序地运行，满足人民群众对司法体制改革的期待，最终维护司法公正，提升司法公信力。
• With the deepening of the judicial system reform, there will be some structural changes in the operation of judicial power. Also the comprehensively implementation of the System for Specified Number of Personnel has brought out the changes and transfers of the risks in according to different positions of judges. So in order to adjust to these changes and have a scientific operation of judicial power, it’s necessary to establish a new system of risk prevention and solutions for the judge under the judicial reform. By taking full advantage of the intelligent technology and scientific management from the information era, we must adjust our measures according to the risks from different positions of the judge. This paper is based on the authentic analysis of the crimes that judge committed these years. Under the judicial system reform, it’s realistic and necessary to establish a new system of risk prevention and solutions for the judge. In this paper, several risks that judges may meet are as follows. By the big data and intelligent technology from the information platform, the author put in forth the overall thinking and several methods in order to cope with the changes of the risks, promote the orderly operation of judicial power, satisfy the public’s expectation of judicial reform and finally safeguard the judicial justice.
