以“泸州遗赠案”为例，浅析法律原则的司法适用

• 摘要： 作为法律的要素之一，法律原则在立法，司法，执法和守法的各个方面都发挥着至关重要的作用。本文将以经典案例“泸州遗赠案”为例，探究该案司法机关适用公序良俗原则判案的理由，并且对饱受争议的黄某遗赠行为合法性进行分析，找出本案判决不足之处以及最佳解决方案。在此基础之上思考公序良俗原则的司法适用标准和方式，并对《继承法》中必留份制度提出些许建议，为将来的类似案件提供应对措施。
• As one of the elements of the law, the principle of law plays a vital role in al aspects of legislation, justice, law enforcement and law-abiding. This article will take the classic case"Luzhou Legacy Case"as an example. In this case, the court applied the principle of public order and good customs to make judgments, which caused a series of disputes. The principle of public order and good custom is one of the basic principles of our civil law. Its main content is to appropriately restrict the free will of the parties and realize the unity of personal interests and social interests. Exploring the reasons for the judiciary's application of the principle of public order and good custom, and analyzing the legality of the controversial Huang's bequest, and finding out the inadequacies of the case and the best solution. On this basis, we will consider the standards and methods of judicial application of the principle of good order and good custom, and make some suggestions on the system of reservations in the Law of Succession, and provide countermeasures for similar cases in the future.
