  • 摘要: 人性究竟所指为何,历来众说纷纭。对于宪政的阐发需要围绕人性论来进行,从人出发,再回到人上来。在人性论上,中西方有着不同的认识,性善与性恶的人性论基础对国家宪政的制约也是不同的。在我国思想史上,关于人性善恶的问题滥觞于孟子,此后性善论常常被视为是专制的人性论基础。性恶论作为一种系统理论在西方出现,起源于基督教,常常被视为是宪政的人性论基础,同时这两种观点也充满悖论。
  • There have always been divergent opinions on what human naturerefers to. The elucidation of constitutionalism needs to revolve aroundthe theory of human nature, starting from people and then returning tothem. In terms of human nature theory, China and the West have differentunderstandings, and the foundation of human nature theory of good andevil nature also has different constraints on national constitutionalism. In thehistory of Chinese thought, the question of the good and evil of human natureoriginated from Mencius, and thereafter, the theory of good nature is oftenregarded as the foundation of authoritarian human nature theory. The theoryof evil in nature, as a systematic theory that emerged in the West and originatedfrom Christianity, is often regarded as the foundation of constitutional humannature theory, and these two views are also full of paradoxes.
