滥用市场支配地位行政处罚适用研究 ——以互联网平台为探索点

• 摘要： 随着网络技术和数字经济的飞速发展，互联网平台的规模和影响力不断扩增，极大的市场支配力掌握在个别互联网平台手中。互联网平台由于具有双边市场、交叉网络外部性、价格结构的不对称性等特点，导致其较其他传统行业而言滥用市场支配地位的情形更为频发，因此，通过反垄断机制抑制互联网巨头滥用市场支配地位至关重要。本文剖析了市场支配地位及相关市场的概念，结合互联网平台的特点，发现互联网平台滥用市场支配地位的成因，分析滥用市场支配地位行政处罚适用的相关案例，就其困境进行问题研究，并提出相关建议，促进互联网平台反垄断制度的完善。
• With the rapid development of network technology and digitaleconomy, the scale and influence of Internet platforms have been expanding,and great market power is in the hands of individual Internet platforms.As Internet platforms are characterized by bilateral markets, cross-networkexternalities, and asymmetric pricing structures, leading to more frequent abuseof market dominance than other traditional industries, it is crucial to curb theabuse of market dominance by Internet giants through the antitrust mechanism.This paper analyzes the concepts of dominant market position and relatedmarkets, combines the characteristics of Internet platforms, discovers the causesof the abuse of dominant market position by Internet platforms, analyzes therelevant cases of the application of administrative penalties for the abuse ofdominant market position, researches the problems on its predicament, andputs forward relevant suggestions to promote the improvement of the antitrustsystem of Internet platforms.
