• 摘要： 医疗损害司法鉴定事关医疗纠纷的妥善解决、医疗纠纷诉讼的顺利进行，事关司法公正与社会稳定。目前医疗损害司法鉴定存在着鉴定材料多、难度大，鉴定人工作压力大、鉴定周期长等问题。人工智能在司法领域、医学领域的应用普遍化、并取得了显著成效。人工智能具有应用于医疗损害司法鉴定领域的优势与可能性，但是医疗损害司法鉴定引入人工智能这个重要变量后，将存在着法律规范付之阙如、人工智能缺乏价值判断、司法鉴定诸概念面临颠覆、鉴定人生存空间受到挤压等实践难题，因必须从理念、制度、技术层面对医疗损害司法鉴定的应用予以规制。
• Forensic identification of medical damage is related to the proper resolution of medical disputes, the smooth progress of medical dispute litigation, judicial justice and social stability. At present, there are many problems in forensic identification of medical damage, such as the material of identification, the difficulty, the pressure of expert work and the long period of identification. The application of artificial intelligence in judicial field and medical field is universal and has achieved remarkable results. Artificial intelligence has the advantage and possibility to apply in the field of medical damage forensic identification, but after medical damage forensic identification introduces the important variable of artificial intelligence, there will be the lack of legal norms, the lack of value judgment of artificial intelligence, the concept of judicial expertise facing Subversive, expert living space is squeezed and other practical problems, because we must regulate the application of medical damage forensic expertise from the aspects of concept, system and technology.
