• 摘要： 网络庭审模式作为现代科技手段与审判深度融合的产物，充分利用互联网高效便捷的特点，让司法资源得到有效的利用，拓展供给辐射效应，提升司法“供给侧”与“需求侧”用户体验。但对网络庭审中证据收集与传输而言，还存在实物证据难以溯源、言词证据认定是否真实自愿、书面材料缺少保全程序以及电子数据缺乏统一标准等问题。分析传统证据在收集与传输的流程不适应网络庭审模式的基础上，结合现行的先进经验与有利探索提出改造的建议，更好地助力司法供给侧改革，为智慧司法深入提供理论支持。
• As a product of the deep integration of modern scientific and technological means and trials, the online trial mode makes full use of the efficient and convenient features of the Internet to make effective use of judicial resources, expand the radiation effect of supply, and enhance the user experience of the judicial “supply side” and “demand side”. However, for the collection and transmission of evidence under the online trial mode, there are still some problems, such as the difficulty in tracing the physical evidence, whether the verbal evidence is true and voluntary, the lack of preservation procedures for written materials and the lack of standards for electronic data. On the basis of analyzing that the traditional evidence collection and transmission process does not adapt to the online court trial mode, this paper puts forward some suggestions on the reform combined with the current advanced experience and favorable exploration, so as to better help the judicial supply-side reform and provide theoretical support for the intelligent justice.
