• 摘要： 现阶段性侵案件高发，对未成年被害人在心理上以及身体上造成的伤害都较重，在一定程度上也引起了社会以及大众的广泛关注。此类案件发生的较隐蔽，被公安机关发现都需要依靠被害人自己主动向公安机关报案，而侦破案件的关键一直都需要从被害人入手，因为案件发生的地点较为隐蔽、无人证、犯罪嫌疑人的口供易出现反复。而未成年被害人陈述的可信度又在一定程度上受到质疑，文章分别从被害人陈述的特征、对被害人进行询问时应注意的问题、影响未成年被害人言词证据可靠性的因素、提高性侵案件中未成年被害人言词证据证明力的建议这四个方面进行分析，分析影响被害人陈述证明力减低的原因，并提出相应的解决建议，希望能够从根本提高未成年被害人言词证据的证明力以及可信度。
• At present, the high incidence of stage assault cases has caused serious psychological and physical harm to the minor victims, which has also aroused widespread concern of the society and the public to a certain extent. The occurrence of such cases is relatively hidden, and the victim needs to take the initiative to report the case to the public security organ when discovered by the public security organ. The key to solving the case has always been to start from the victim, because the place where the case occurs is relatively hidden, there is no evidence, and the confession of the suspect is easy to be repeated. And underage victim statement’s credibility has been questioned, to a certain extent this paper respectively from the victim statement the characteristics, problems should be paid attention to when to ask the victim, the factors affecting the reliability of the underage victim oral evidence, enhance the juvenile victim abuse that oral evidence suggest that the four aspects of analysis, This paper analyzes the reasons that affect the reduction of the proof power of the victim’s statement, and puts forward corresponding solutions, hoping to fundamentally improve the proof power and credibility of the juvenile victim’s speech evidence.
