• 摘要： 网络科技的发展在推动社会进步的同时也催生了新的犯罪活动。近年来，网络赌博和网络开设赌场活动层出不穷，相较于传统网络赌博活动有新的特点。新型开设赌场案件中，电子数据是案件证据链的重要一环，电子数据的提取、处理、鉴定直接影响到电子数据的证据能力。本文从某聊App开设赌场一案出发，在实践中捕捉电子数据运用时可能存在的问题，从电子证据的取证、审查、鉴定、质证、认证等环节为其在诉讼中的运用提供新思路，并提出电子数据相关问题的对应建议，提升电子数据证据在法庭调查中的采信率。
• The development of internet technology has given rise to new criminal activities as well as social progress. In recent years, there has been a proliferation of online gambling and online casino activities, which have new characteristics compared to traditional online gambling activities. In the new casino case, electronic data is an important part of the case evidence chain, and the extraction, processing and identification of electronic data directly affects the evidentiary capacity of electronic data. This paper starts from a case of casino opening by a chat app, captures the possible problems in the use of electronic data in practice, provides new ideas for its use in litigation from the forensics, examination, identification, cross-examination and authentication of electronic evidence, and proposes corresponding suggestions for electronic data-related issues to enhance the admissibility of electronic data evidence in court investigations.
