  • 摘要: 作为信息技术时代的产物,区块链存证技术在大数据驱动下得到普遍应用。为了满足司法实践中电子签名笔迹鉴定日益增长的需求,提高电子签名笔迹鉴定可靠性和效率,有效提升鉴定意见在司法活动中的可靠性,将区块链技术引入到电子签名笔迹鉴定活动中将会是技术与司法结合的新方向。通过对电子签名笔迹的形成过程、电子签名笔迹鉴定的实施过程以及电子签名笔迹鉴定意见的运用过程三阶段进行上链保存,构建完整、安全的鉴定系统。同时,对基于区块链存证技术的电子签名笔迹鉴定面临的制度、 法律及技术风险,也应从制度监管、法律明确及技术规范等层面予以回应。由此,才可促进司法与技术的融合发展。
  • As a product of the information technology era, blockchain certificate storage technology has been widely applied under the drive of big data. In order to meet the growing demand for electronic signature handwriting authentication in judicial practice, improve the reliability and efficiency of electronic signature handwriting authentication, and effectively improve the reliability of expert opinions in judicial activities, the introduction of blockchain technology into electronic signature handwriting authentication will be a new direction of technology and justice. A complete and safe identification system is built by keeping the electronic signature handwriting in three stages: the formation process, the implementation process of electronic signature handwriting identification, and the application process of electronic signature handwriting identification opinions. At the same time, the institutional, legal and technical risks faced by electronic signature handwriting authentication based on blockchain certificate storage technology should also be responded from the aspects of institutional supervision, legal clarity and technical specifications. Only in this way can we promote the integration and development of justice and technology.
