• 摘要： 党的二十大提出了中国式现代化的伟大时代命题。与西方中心主义驱动下以资本驱动为核心的阶级对立严重的现代化不同，中国式现代化是在马克思主义思想指导下推进人的全面发展的现代化。在这一进程中，法治是中国式现代化的重要保障。尤其是在百年未有大变局和世界疫情叠加的严峻背景下，广东民营企业在面对国家经济迭代升级和社会高速发展过程中可能存在一些违法违规甚至犯罪的经营活动。如何有效对其进行刑事司法保护，推动广东广大民营企业可持续发展是当前中国式现代化法治建设领域亟待解决的重要问题。基于国内已经发展比较成熟的认罪认罚从宽制度与企业合规实践，探索二者衔接优化路径，从而为构建广东优良的法治营商环境，为全面推进中国式现代化的广东实践提供有力的法治保障。
• ἀe 20th National Congress of the Communist Party of China put forward the great era proposition of Chinese-style modernization, which is very diḀerent from the modernization driven by Western-centrism with capital-driven class antagonism as the core, Chinese-style modernization is the modernization of promoting the all-round development of people under Marxist thought, and the rule of law is an important guarantee for Chinese-style modernization in this process. Especially under the severe background of the unprecedented major changes in a century and the superposition of the world epidemic, Guangdong private enterprises have more or less illegal and even criminal business activities in the face of the iterative upgrading of the national economy and the rapid development of society. How to eḀectively protect them in criminal justice and promote the sustainable development of private enterprises in Guangdong is an important proposition that needs to be solved urgently in the ᴀeld of Chinese-style modern rule of law. Based on the relatively mature leniency system for guilty pleas and punishment and the compliance practice of enterprises in China, explore the path of connection and optimization of the two, so as to provide a strong legal guarantee for building an excellent business environment under the rule of law in Guangdong and comprehensively promoting the practice of Chinese-style modernization in Guangdong.
