“刷单”类电诈案件中电子数据的真实性认定研究

• 摘要： 本研究聚焦于“刷单”类电信网络诈骗犯罪案件中电子数据的真实性认定问题。基于部分审判人员在司法实践中“不采信、不认可”电子数据真实性的现状，分析了电子数据真实性认定难的原因，并梳理了互联网时代的电子数据真实性证明观。依据“刷单”案件的特征，本文归纳出“刷单”行为模型，并通过类案特点和行为模型的交叉分析，总结得到“刷单”案件中真实性认定的类案参考依据，为互联网时代真实性证明观下该类案件电子数据真实性的认定提供一种参考思路。
• This study focuses on the authenticity of electronic data in the case of telecommunication network fraud, and analyzes the difficulties in determining the authenticity of electronic data based on the current situation that some judges "do not accept or recognize" the authenticity of electronic data in judicial practice. Reasons, sorted out the Internet era of electronic data authenticity proof view. This paper tries to summarize the behavior model of "brush single" based on the characteristics of "brush single" cases, and through the cross-analysis of the characteristics and behavior model of such cases, summarizes the authenticity of "brush single" cases. Through the cross-analysis of the characteristics and behavior model, we can summarize the reference basis of authenticity in the case of "swipe", and provide a reference idea for the determination of the authenticity of the electronic data in the case under the view of authenticity proof in the Internet era.
