• 摘要： 非确定鉴定意见目前面临的困境导致其在诉讼中的审查与运用也面临着阻碍，但是非确定鉴定意见作为一种证据也具备一定的证据价值，其重要性不容忽视。合理地运用非确定鉴定意见不仅可以扩充法官的认识对象，弥补法官在专门性问题上的认识不足，更有助于法官查明案件事实真相。本文以2020—2022年的裁判文书为分析样本，从笔迹鉴定的角度分析非确定性鉴定意见在实务中的审查与运用，旨在为实践中非确定性笔迹鉴定意见的审查与运用提出一些建议，进而最大化地发挥非确定性笔迹鉴定意见在诉讼案件中的证据作用。
• The current predicament of non-conclusive expert opinion leads to its review and application in litigation also faces obstacles, but as a kind of evidence, non-conclusive expert opinion also has a certain evidential value, its importance can not be ignored. Reasonable use of non-deterministic expert opinion can not only expand the judge’s knowledge object, make up for the judge’s lack of knowledge on specialized issues, but also help the judge to find out the truth of the case. Based on the judgment documents from 2020 to 2022, this paper analyzes the review and application of non-deterministic handwriting appraisal opinions in practice from the perspective of handwriting appraisal, aiming to put forward some suggestions for the review and application of non-deterministic handwriting appraisal opinions in practice, so as to maximize the role of non-deterministic handwriting appraisal opinions as evidence in litigation cases.
