• Abstract: With the in-depth application of blockchain technology in the monetary field, virtual currencies with data as the carrier have realized the digital embodiment of property value, which in turn has triggered dual discussions in the fields of financial regulation and criminal proceedings. Different from traditional property involved in cases, the unique attributes of virtual currency make the current disposal mode difficult to meet the needs of disposing property involved in currency-related cases in judicial practice, and public security and judicial organs are facing dual challenges in terms of disposal rules and disposal capabilities. In view of this, this article from the characteristics of virtual currency and its legal risks, respectively, from the attributes of the procedure, disposal of the main body, technical methods, governance effectiveness of the four dimensions of the current criminal virtual currency disposal of the problems of deconstruction and analysis, and puts forward a number of corresponding regulation and improvement measures, aiming to provide reference for exploring new paths for the disposal of criminal virtual currency involved in cases. 随着区块链技术在货币领域的深度运用，以数据为载体的虚拟货币实现了财产价值的数字化体现，进而引起了金融监管和刑事诉讼领域的双重探讨。区别于传统涉案财物，虚拟货币的独特属性使得现行的处置模式难以满足司法实践中涉币类案件涉案财物的处置需要，公安司法机关正面临着处置规则与处置能力的双重挑战。有鉴于此，本文从虚拟货币的特征及其引发的法律风险出发，基于属性程序、处置主体、技术方法、治理效能四个维度对当前刑事涉案虚拟货币处置存在的问题进行解构和分析，并提出相应的规制与完善措施，旨在为探索刑事涉案虚拟货币处置新路径提供参考。
