Abstract:
While the development of digital technology has brought convenience, it has also created the emergence of cyberbullying, leading to frequent malicious cyberbullying incidents. As the core breeding ground for cyberbullying, online platforms often adopt a passive approach in practice by invoking the “safe harbor principle”, which clearly fails to effectively govern illegal cyberbullying acts. The connotation of CPTED (Crime Prevention Through Environmental Design) is to reduce crime and lower future crime rates by shaping specific environments. Accordingly, online platforms should reconstruct their online environments at both macro and micro levels based on this theory, redesign criminogenic algorithmic recommendation mechanisms, transcend the role of digital gatekeepers to eliminate criminogenic factors, monitor key groups and emergent incidents, and accept multi-stakeholder supervision. This will help trace the source of cyberbullying, effectively prevent its occurrence and the expansion of harm, protect users’ legitimate rights and interests from infringement, and realize proactive prevention in cyber governance under criminal law.
数字技术在为社会生活提供便利的同时,也催生了网络暴力,恶性网络暴力事件屡有发生。网络平台作为网络暴力滋生的核心载体,在实践中常基于“避风港原则”进行消极处理,无疑难以有效治理网络暴力违法行为。CPTED理论内涵,是通过营造特定环境减少犯罪和降低未来犯罪率。因此,网络平台应当基于该理论,从宏观和微观上重构网络平台环境,重新设计平台的犯因性算法推荐机制,在超越数字守门人的角色定位下泯除犯因,把控重点人群和突发性事件,接受多方监督。这有利于溯源网络暴力,有效防止网络暴力的发生及危害的扩散,保护用户的合法权益不受侵犯,实现刑事法网络治理的预先防治。
