“剧本杀”游戏剧本版权保护的失范与规范

• 摘要： 剧本是“剧本杀”游戏的核心，现阶段“剧本杀”面临的版权问题主要围绕剧本展开，体现为剧本创作阶段的跨媒介改编侵权、投稿和测试阶段剧本创意剽窃和剧本上线后的非法复制传播。当前“剧本杀”游戏产业急速扩张背景下，剧本显现出来的巨大商业价值，是引发版权问题的社会经济根源，剧本版权保护法规不完善和著作权人维权积极性低落也给不法分子以可乘之机。针对上述现象，至少需要从立法、普法和执法，提高“剧本杀”游戏各环节从业者的行业自律、玩家个体的规范意识等多层面、多维度来约束侵权行为，方能助力市场从失范走向规范。
• Script is the core of the script murder game. At this stage, the copyright problems faced by thescript murder game mainly revolve around scripts, which are reflected in the cross-media adaptationinfringement at the script creation stage, plagiarism at the submission and testing stages, and the illegalcopying after the release of the scripts. Against the backdrop of the rapid expansion of the gamingindustry, the enormous commercial value demonstrated by scripts is the social and economic rootof copyright issues. The imperfect copyright protection laws and regulations for scripts and the lowenthusiasm of copyright owners for protecting their rights also provide opportunities for criminalsto take advantage of. In response to the above phenomenon, it is necessary to at least make the law,popularize the law, and enforce the law, enhance the industry self-discipline of script murder operatorsin various aspects of script killing games, and enhance the awareness of individual players’ norms toconstrain infringement behavior at multiple levels and dimensions, to help the market move fromanomie to normalization.
