浅议我国新《著作权法》 中有关阅读障碍者的限制与例外规定

• 摘要： 新《著作权法》第一次较全面地做出了有关阅读障碍者的限制与例外规定，这些规定对《马拉喀什条约》既有借鉴又有突破，但与《马拉喀什条约》对比仍存在完善的空间。需要参考《马拉喀什条约》厘清“阅读障碍者”和“无障碍方式”的概念；限制与例外适用的专有权利范围的表述可能造成理解和适用上的偏差，建议立法者修改表达方式；删除了“不以营利为目的”的前提可能导致法律规定被滥用，建议引入被“被授权实体”机制。
• The Latest Copyright Law of the People's Republic of China has made more comprehensive limitations and exceptions for persons with print disabilities,for the first time. The provision has both reference and breakthrough for the Marrakesh VIP Treaty, but there is still room for improvement.It is necessary to refer to the Marrakesh VIP Treaty to clarify the concepts of "persons with print disabilities" and "accessible methods"; the expression of the scope of exclusive rights to which limitations and exceptions apply may causes deviations in understanding and application,the legislator is recommended to modify the expression; The removal of the premise of "not for profit" may lead to abuse, and it is recommended to introduce an "authorized entity" mechanism.
