民间借贷纠纷诉讼中证明责任的判断

• 摘要： 近些年来，我国法院审理的民间借贷纠纷案件的数量不断增多，该类案件的复杂矛盾之处也愈见明显。我国虽然对处理该类案件已出台了相关司法解释，但是民间借贷案件的一个最大的特点就是案情复杂多元化，我们无法完全穷尽民间借贷纠纷案件的案情，这使我们现在在处理民间借贷纠纷案件上还无法形成系统的证明责任分配规则。本文先粗略地列举分析了法院在民间借贷纠纷案件上的审理难题，然后阐述了我国现阶段有关民间借贷案件的证明责任分配规则，最后列举了大量的司法审判案例来分析在具体情形下应如何判断和认定民间借贷证明责任。
• In recent years, the number of private loan dispute cases tried byChinese courts has been increasing, and the complex contradictions of suchcases have become more and more obvious. Although China has issued relevantjudicial interpretations for the handling of such cases, one of the biggestcharacteristics of private lending cases is the complexity and diversity of cases.We cannot completely exhaust the cases of private lending disputes, whichmakes it impossible for us to form a systematic distribution of responsibilitiesfor handling private lending disputes. Rules. This article first roughly lists andanalyzes the difficult problems of the court in the trial of private lending disputecases, then elaborates the rules for the allocation of certification liability forprivate lending cases in China at this stage, and finally lists a large number ofjudicial trial cases to analyze how to judge and determine the burden of proof ofprivate lending under specific circumstances.
