从法律视角上探讨数字货币在我国的发展与规制

• 摘要： 自进入数字经济时代后，数字货币作为一种新型产物便出现在了人们的视野中，它促进了国家实体经济与数字经济的密切融合，实现了金融科技的高速发展与进步。但面对这种新型产物，当下我国并没有确定其法律属性，也没有一套完整的监管体制来约束数字货币的运行模式，这无疑就会存在着一定的安全风险，进而将会导致各种侵害财产类、非法集资类等犯罪案件的发生。因此，我国对数字货币在发行、 流通等过程中必须进行全方位监控，从立法、执法、司法上对其进行系统地规制，以保障我国数字货币总体运行安全、公民的合法权益不受侵犯。
• Since entering the era of Digital Economy, digital currency as a new product has appeared in people’s eyes, it promotes the close integration of national real economy and digital economy, and realizes the rapid development and progress of financial technology. But facing this kind of new product, our country has not confirmed its legal attribute, also does not have a complete set of supervisory system to restrict the digital currency movement pattern, this will undoubtedly have certain security risk, in turn, it will lead to the occurrence of various crimes such as property infringement, illegal fund-raising and so on. Therefore our country must carry on the omni-directional monitoring to the digital currency in the issuance, the circulation and so on process, carries on the systematic regulation to it from the legislation, the law enforcement, the judicature, in order to guarantee our country digital currency overall operation safety, the citizen’s legitimate rights and interests inviolable.
