学校体育伤害事故中的归责原则与防范措施研究

• 摘要： 我国目前学校体育伤害事故在学校伤害事故中仍占比较高，为了学校体育工作正常开展和防止体育伤害事件进一步增加，以现有法律法规为基础，运用文献资料法、案例分析法和逻辑分析法对学校体育伤害事故内涵进行了界定，对其归责原则与防范措施等问题进行研究 。认为应坚持过错原则为核心归责原则，辅以公平责任原则与自甘风险原则，以此构成“多元归责”原则。提出学校体育伤害事故的防范措施：加强体育相关法律法规立法，建立健全体育保险制度，推进伤害处理程序的规范化进程，建立学校体育安全管理体系。
• My country’s current school sports injury accidents still account for a relatively high proportion of school injury accidents. In order to carry out school sports work normally and improve students’ physical health goals, based on existing laws and regulations, the use of literature data method, case analysis method and logical analysis The law defines the connotation of school sports injury accidents, and conducts research on the principles of liability and preventive measures. It is believed that our country should construct the principle of “multiple imputation” with the principle of fault as the mainstay, and the principle of fair responsibility and self-contained risk as the supplement. Put forward measures to prevent school sports injury accidents: improve the sports laws and regulations system, build a perfect sports insurance system, promote the standardization process of injury handling procedures, and establish a school sports safety management system.
