我国羁押必要性审查制度之再审视

• Abstract: The present situation of detention necessity review system in China is characterized by high arrest rate of criminal cases and low proportion of detention necessity review. The reasons lie in the lack of the neutrality of the subject of examination, the imperfect rules of proof of the necessity of custody, the lack of rigidity of examination result, the lack of relief measures and the inadequate application of alternative measures of custody. In response, the neutrality of the subject of examination should be maintained, reasonably establish the rules of proof, endow the result of the examination with the power of enforcement, establish the remedy way of examining the necessity of detention, and improve the rate of applying the alternative measures of detention. 我国羁押必要性审查制度运行现状表现为刑事案件逮捕率畸高、羁押必要性审查比例较低。其原因在于，审查主体中立性不足、羁押必要性证明规则不完善、审查结果缺乏刚性、未规定救济措施、羁押替代措施运用不足。对此，应当保持审查主体的中立性、合理确立证明规则、赋予审查结果强制执行力、建立羁押必要性审查救济途径、提高羁押替代性措施适用率。
