论中国外资准入负面清单制度的发展与完善

On the Development and Perfection of the Negative List system for Foreign Investment Admittance in China

• Abstract: Since the establishment of the Shanghai Free Trade Zone in 2013, the negative list system for foreign investment access has attracted wide attention as one of the important measures to promote investment and development. This system also fully embodies the concept of pre-establishment national treatment, can safeguard national economic security, promote the interaction between multiple subjects, and promote the vigorous development of the market. While affirming the positive benefits of the negative list system, we also need to recognize that the current negative list system has a series of problems. In view of the above problems, this paper combined with the domestic development situation and the practical experience of other countries, put forward relevant suggestions for improvement. 自2013 年上海自贸区建立以来，外资准入负面清单制度作为推动投资开发方的重要举措之一，受到广泛关注。这一制度也充分体现准入前国民待遇的理念，能够维护国家经济安全，促进多主体之间的相互作用，促进市场蓬勃发展。在肯定负面清单制度积极效益的同时，我们也需要认识到，当前负面清单制度存在系列问题。针对上述问题，本文结合国内发展状况及他国实践经验，提出相关完善建议。
