• 摘要： 以宪法与部门法互动为中心，从法治实践的角度出发，发现立法、司法及法律监督领域存在的各种问题。而这些解决问题需要厘清部门法与法治实践之间的关系，这段关系需要从四个维度来观察，分别是从法制到法治、法治思维与法治手段的推进与限制、二者交互关系及国际化影响。总的来说法治实践与部门法之间存在交互关系，二者互相影响的同时也互相促进。但是这种关系的互动并非总处于良好状态，例如法律草案审议制度、备案审查制度、宪法解释工作都存在相应问题，以及关于法律具体化之思考。
• Focusing on the interaction between the Constitution and the department law, from the perspective of the practice of rule of law, this paper finds out various problems existing in the fields of legislation, judicature and legal supervision. To solve these problems, we need to clarify the relationship between the departmental law and the practice of rule of law, which needs to be observed from four dimensions, from the rule of law to the rule of law, the rule of law thinking and the rule of law means to promote and limit the interaction between the two and the impact of internationalization. Generally speaking, there is an interactive relationship between the practice of rule of law and the departmental law. But the interaction of this kind of relation is not always in a good state, for example, there are some problems in the examination system of draft law, the system of record review, the work of constitution interpretation, and the thinking of law concretization.
