• 摘要： 随着法治国家建设的推进，未成年人犯罪越来越受到社会公众的关注。日渐上升的未成年人犯罪案件数量，和频发的恶性未成年人犯罪案件的曝光，使得司法工作人员和一般社会公众都对我国《刑法》规定的最低刑事责任年龄产生了疑问。不可否认的是目前的规定已经不再符合社会发展和未成年人的身心发展水平，一味地维持法律的稳定性只会损害法律的权威性。并且，下调最低刑事责任年龄并不意味着违背现行理念和国家政策，反而是一种维护。因此，对刑 事责任年龄予以突破，这不仅是对《刑法》的完善，更是对社会稳定的促进和推动。
• With the advancement of the construction of a country under the rule of law, juvenile delinquency has attracted more and more public attention. The increasing number of juvenile criminal cases and the frequent exposure of malignant juvenile criminal cases make both the judicial staff and the general public have questions about the minimum age of criminal responsibility as stipulated in the Criminal Law of China. It is undeniable that the current provisions are no longer in line with the social development and the physical and mental development level of minors, and blindly maintaining the stability of the law will only aggravate the damage to the authority of the law. Moreover, lowering the minimum age of criminal responsibility does not mean a violation of current ideas and national policies, but is a kind of maintenance. Therefore, to break through the age of criminal responsibility is not only the improvement of the Criminal Law, but also the promotion and promotion of social stability.
