• 摘要： 虚拟货币作为区块链技术的重要支撑，在区块链技术快速发展的背景下呈现出多样化的发展趋势。当前学界对虚拟货币法律属性尚未形成统一观点。虚拟货币法律属性的确立是对窃取虚拟货币行为刑法规制的基础。虚拟货币具有财产属性，能够解释为刑法意义上的财物。对窃取虚拟货币行为以计算机犯罪进行规制存在理论上与实践上的难点。以财产属性为依据、以盗窃罪论处符合行为人窃取行为的主观预期，也符合罪责刑相适应原则的要求，同时还能保障被害人的权利。以虚拟货币日交易均价作为窃取行为数额计算依据标准，相对准确也符合被害人财产权利的保护要求。
• As an important support for blockchain technology, virtual currency presents a diversified development trend in the context of the rapid development of blockchain technology, and the criminal illegal phenomenon of virtual currency is prominent. At present, the academic community has not yet formed a unified view on the legal attributes of virtual currency. The establishment of the legal attributes of virtual currency is the basis for the criminal regulation of the theft of virtual currency. Virtual currency has property properties and can be interpreted as property in the sense of criminal law. There are theoretical and practical difficulties in regulating the theft of virtual currency by computer crime. The punishment of the crime of theft on the basis of the property attribute conforms to the subjective expectation of the perpetrator’s theft behavior, and also meets the requirements of the principle of proportionality of criminal responsibility and punishment, and at the same time protects the rights of the victim. Using the average daily transaction price of virtual currency as the basis for calculating the amount of theft, the standard is relatively determined, and it is also in line with the protection of victims’ property rights.
