• 摘要： 随着《民法典》和《个人信息保护法》的相继颁布和实施，隐私权和个人信息权益之间的关系亟待厘清，如何正确地适用隐私权规则和个人信息保护规则，成为当今社会不可回避的重要课题。在梳理清楚隐私权与个人信息权益二者关系的基础之上，通过比较法研究等方法考察我国立法上对隐私权和个人信息权益的区分保护，进而从《民法典》和《个人信息保护法》所构建的宏观个人信息保护体系的视角出发，分析隐私权规则和个人信息保护规则的具体内容和差异，并探究上述两规则的适用路径，以期为法律理论和实践提供参考和指引。
• With the promulgation and implementation of the Civil Code andthe Personal Information Protection Law, the relationship between privacyand personal information rights and interests needs to be clarified, and howto correctly apply privacy rules and personal information protection rules hasbecome an unavoidable and important issue in today’s society. On the basis ofclarifying the relationship between privacy and personal information rights,this paper examines the differentiated protection of privacy and personalinformation rights and interests in China’s legislation through comparative lawresearch, and then analyzes the specific content and differences between privacyrules and personal information protection rules from the perspective of themacro personal information protection system constructed by the Civil Codeand the Personal Information Protection Law, and explores the applicationpath of the above two rules, in order to provide reference and guidance for legaltheory and practice.
