On the Essence and Effect of the Time Limit of Order for Performance in Administrative Litigation —Analysis of the Ferry Administrative License Case of Qidong Fasheng Shipbuilding Engineering Co., Ltd. v. Qidong People’s Government
Abstract:
In administrative litigation, the people’s court orders administrativeorgans to fulfill their statutory responsibilities, which is a remedy foradministrative inaction caused by the administrative counterpart, and is alsoan important measure for substantive resolution of administrative disputes.Ordering the performance of statutory duties is the result of the intersection ofjudicial power and administrative power. Judicial power directly supervises andadjusts the exercise of administrative power through the procedural value andeffectiveness of the performance period. The law does not have clear provisionson how the people’s court determines the performance period, resulting inunclear standards when judging the legality of administrative actions taken byadministrative organs within the performance period. The people’s court shouldfully utilize its judicial discretion, determine a timely and feasible time limit forperformance in accordance with legal norms and specific case situations.
人民法院在行政诉讼当中责令行政机关履行法定职责是针对行政相对人因行政不作为而采取的救济方式,也是实质性解决行政争议的重要措施。责令履行法定职责是司法权与行政权交汇的结果,司法权通过履行期限具有的程序性价值和效力直接监督、调整着行政权的行使。法律对于人民法院如何确定履行期限并没有明确规定,导致在判断行政机关在履行期限内作出行政行为的合法性时标准模糊。人民法院应当充分运用好司法裁量权,依据法律规范的规定并结合具体案情确定及时、可行的履行期限。
