• 摘要： 个人破产准入路径规制是个人破产制度有效运行的前提和基础，规范个人破产申请标准，为发挥个人破产制度解决社会矛盾的作用提供有效调节机制。关于个人破产立法模式，应先予区分债务人的破产能力，确定债务人的破产资格，以国外个人破产立法历史沿革为借鉴，立足我国个人破产实践，采取一般个人主义破产立法模式，最大程度覆盖所有的债务人，平等保护债权人、债务人的基本权利，帮助各类债务人走出清偿不能的困境，进一步完善市场退出机制。继而在立法模式的基础上，进一步区分债权人和债务人的破产原因，结合案件“审查受理”模式，将“诚而不幸”的债务人纳入个人破产法律制度的保护范围内，实现个人破产法律制度的价值最大化。
• The regulation of individual bankruptcy access path is the premiseand basis of the effective operation of personal bankruptcy system, standardizesthe standard of personal bankruptcy application, and provides an effectiveadjustment mechanism for playing the role of personal bankruptcy system insolving social contradictions. About personal bankruptcy legislation mode,should first to distinguish the debtor’s bankruptcy ability, determine thedebtor’s bankruptcy qualification, with foreign personal bankruptcy legislationhistory for reference, based on personal bankruptcy practice, adopt generalindividualism bankruptcy legislation mode, maximum cover all the debtor,equal protection of the creditor, the debtor, help all kinds of debtor out of theplight of liquidation, further improve the market exit mechanism. Then, on thebasis of the legislative mode, the bankruptcy reasons of creditors and debtorsare further distinguished, and combined with the “review and acceptance” modeof cases, the “honest and unfortunate” debtors are included in the protectionscope of the personal bankruptcy legal system, so as to maximize the value ofthe personal bankruptcy legal system.
