• 摘要： 我国《公共图书馆法》的出台明确了公共图书馆的文化保存与传承功能，并规定公共图书馆可以向公众提供数字资源。公众获取数字资源进行学习研究已经在网络环境下常态化。由于版权规则的限制，公共图书馆对数字资源的保存和传承功能被削弱，公众对数字文献的免费获取存在障碍。数字资源获取的便利性和数字资源研究的日常化使得人们尝试将现行文本资源的版权规则套用到数字资源的传播模式中来，但各种许可模式都存在缺陷。这也表明，现行著作权法规则无法确保网络环境下公共图书馆文献保存与传播功能的有效发挥，应适时修改相关条款，以维护数字资源传播过程中各主体之间的利益平衡。
• The Law on Public Libraries in our country clearly defines thefunction of Public Libraries. Public libraries can provide digital resources tothe public. Public access to digital resources for learning has been normalizedin the network environment. Due to the limitation of copyright rules, thefunction of preserving and inheriting digital resources in public libraries hasbeen weakened, and public access to digital documents has been hindered.The convenience of obtaining digital resources and the daily research of digitalresources have made people try to apply the copyright rules of current textresources to the digital resources. However, no feasible solution has beenformed. It is not appropriate to copy the existing rules for copyright rules ofpublic libraries to acquire digital resources, but should pay attention to thebalance of interests among all the subjects.
