元宇宙时代NFT数字藏品的法律属性及规制方向

• 摘要： 元宇宙是整合多种新技术而产生的虚实相融的新型社会形态，NFT数字藏品则是在元宇宙背景下应用区块链技术所形成的网络虚拟产品。近年来，NFT数字藏品逐渐成为元宇宙数字经济发展的新业态且日趋繁荣，伴随而来的便是风险防范和法律规制问题。目前学界关于元宇宙和NFT数字藏品的研究尚处于初级阶段，在对其进行法律规制时容易产生较大的争议。本文从元宇宙与NFT数字藏品间的关系入手，对NFT数字藏品的法律属性作出辨析，同时对元宇宙和NFT数字藏品的内生风险及法律规制提出了建议，希望能够充分发挥NFT数字藏品的特点和优势，推动元宇宙数字经济的快速发展。
• The metaverse is a new social form of virtual and real integration generated by the integration of a variety of new technologies, and the NFT digital collection is a network virtual product formed by the application of blockchain technology in the context of the metaverse. In recent years, NFT digital collections have gradually become a new form of metaverse digital economy development and become increasingly prosperous, which is accompanied by risk prevention and legal regulations. At present, the research on the metaverse and NFT digital collections is still in the initial stage, and it is easy to produce great disputes when it is regulated by law. Starting from the relationship between the metaverse and the NFT digital collection, this paper analyzes the legal attributes of the NFT digital collection, and puts forward suggestions on the endogenous risks and legal regulations of the metaverse and NFT digital collection, hoping to give full play to the characteristics and advantages of the NFT digital collection and promote the rapid development of the metaverse digital economy.
