A Comparative Law Perspective on the Expert Assistant System: A Preliminary Analysis

• Abstract: In China’s civil litigation system, the current regulations concerning expert assistants are rather brief. This, in turn, leads to a lack of clear operational guidance when applying the expert assistant system in judicial practice, significantly hindering the effective implementation of this system. This article aims to conduct a detailed exploration and analysis of the expert systems in relevant foreign countries, and based on an examination of the legislative and judicial practice status of the expert assistant system in China’s civil litigation, it designs a series of specific and targeted construction strategies to optimize and improve the expert assistant system in the civil litigation field. 在我国民事诉讼体系中，关于专家辅助人的现行规定显得较为简略，这进而造成在司法实践中应用专家辅助人制度时缺乏明确的操作性指引，显著阻碍了该制度的有效实施。本文旨在通过对国外相关国家专家制度的详尽探究与分析，并在审视我国民事诉讼中专家辅助人制度的立法及司法实践现状的基础上，为优化并健全我国民事诉讼领域的专家辅助人制度，设计了一系列具体且有针对性的构建策略。
