网络民意与司法互动的多维审视——以江歌案和昆山反杀案为例

  • Abstract: With the rapid development of the Internet, the influence of online public opinion in social life has become increasingly prominent. In the field of justice, the impact of online public opinion on the judiciary has also attracted more and more attention. As cases with significant social impact in recent years, the Jiang Ge case and the Kunshan antihomicide case provide excellent research samples for us to deeply explore the relationship between online public opinion and justice. In the Jiang Ge case, Jiang Ge, a student studying in Japan, was brutally murdered by Chen Shifeng, the boyfriend of Liu Xin, a girl who lived with him, at the door of his apartment in Tokyo, Japan. After the case occurred, the trial was conducted in Japan in accordance with the principle of territoriality, applying the Japanese criminal law. The case has aroused widespread attention and discussion on the Internet, in the Kunshan anti-homicide case, Liu Hailong drove drunk and forcibly turned into a non-motorized lane, and almost hit Yu Haiming on the non-motorized lane. Subsequently, Liu Hailong ran to Yu Haiming and punched and kicked him, and then took a long knife and hit Yu Haiming with a knife continuously. After the long knife was taken off, Yu Haiming picked up the long knife first and swung 5 knives at Liu Hailong in 7 seconds. More than an hour later, Liu Hailong died. The case also caused a huge stir on the Internet. Through the comparative analysis of these two cases, we can better understand the role of online public opinion in the judicial process and provide theoretical support for the construction of a more reasonable interaction mechanism between the judiciary and public opinion. 随着互联网的迅猛发展,网络民意在社会生活中的影响力日益凸显。在司法领域,网络民意对司法的影响也愈发引起人们的关注。江歌案和昆山反杀案作为近年来具有重大社会影响的案例,为我们深入探讨网络民意与司法的关系提供了绝佳的研究样本。江歌案中,留日学生江歌在日本东京公寓门口被同住女孩刘鑫男友陈世峰残忍杀害。案件发生后,根据属地原则适用日本刑法在日本进行审判。此案在网络上引发了广泛的关注和讨论,昆山反杀案中,刘海龙醉酒驾车并强行拐入非机动车道,险些撞上非机动车道上的于海明,随后,跑向于海明并对其拳打脚踢,后又取长刀连续击打于海明。长刀脱手后,于海明抢先捡起长刀,在7秒内向刘海龙挥出5刀。一个多小时后,刘海龙死亡。此案在网络上也引起了巨大的轰动。这两个案例的共同之处在于,它们都在网络上引发了广泛的关注和讨论,通过对这两个案例的比较分析,我们可以更好地理解网络民意在司法过程中的作用,为构建更加合理的司法与民意互动机制提供理论支持。
