• Abstract: Since entering the era of charity law, the scale of charitable trusts in China has increased significantly. However, in the face of problems such as the lack of preferential tax policies and imperfect regulatory mechanism, the development of China’s charitable trust system over the years is not as good as expected. This paper will take the construction of China’s charitable trust supervisor supervision system as the starting point, and build a charitable trust supervisor supervision system with civil affairs departments as the main body of power, including the appointment of supervisors, litigation rights, supervision and investigation, and the change of the power of dismissed supervisors, by drawing lessons from other jurisdictions and China’s relevant experience. At the same time, combined with the credit records of supervisors, punishment for dishonesty and the supervision system of procuratorial organs, a comprehensive supervision system for charitable trust supervisors should be constructed. This paper aims to provide theoretical support and practical guidance for the further improvement of China’s charity law and promote the vigorous development of philanthropy in China. 自进入《慈善法》时代以来，我国慈善信托的规模取得了显著增长。但因面临诸如税收优惠政策缺失、监管机制不健全等问题，我国慈善信托制度多年来发展得并不如预期。本文将以我国慈善信托监察人监管制度的构建为切入点，通过借鉴其他法域以及我国的相关经验，构建以民政部门为权力主体，包括指定监察人、诉讼权利、监督调查，以及变更解任监察人权力在内的慈善信托监察人监督体系。同时，结合监察人信用记录、失信惩戒以及检察机关监督制度，构建全面的慈善信托监察人监管系统。本文旨在为我国《慈善法》的进一步完善提供理论支持和实践指导，促进我国慈善信托事业的蓬勃发展。
