- Abstract: The large-scale expansion of the gaming industry market and the continuous increase in profits have made gaming trade secrets a key asset for companies to build core competitiveness. These trade secrets cover diverse forms and are characterized by high innovation, easy replicability and strong liquidity. Consequently, they also face multiple challenges, including covert infringement methods, ambiguous identification standards, and fragmented protection systems. With the official implementation of the nation’s first standards for the protection of trade secrets in the online gaming sector, numerous typical cases have emerged in judicial practice. Against this backdrop, this article systematically outlines the scope of gaming industry trade secrets and the forms of infringement, deeply analyzes prominent issues in legal application, judicial recognition, and corporate prevention, and finally proposes practical and targeted solutions from four dimensions: legislative improvement, judicial optimization, corporate risk control, and industry collaboration. This aims to provide theoretical support and practical reference for the innovative development and compliance governance of the gaming industry. 我国游戏行业市场规模扩张和收益不断增加使游戏商业秘密成为相关企业构筑核心竞争力的关键资产。其具有涵盖多元形态，兼具高创新性、易复制性与强流动性的特质，也因此面临着侵权手段隐蔽化、认定标准模糊化、保护体系碎片化的多重困境。恰逢全国首个网络游戏领域商业秘密保护标准正式实施，司法实践中也出现诸多典型判例，本文以此为背景，系统梳理游戏行业商业秘密的界定范围与侵权行为样态，深入剖析法律适用、司法认定、企业防控等层面的突出问题，最终从立法完善、司法优化、企业风控、行业协同四个维度，提出兼具针对性与可操作性的破解路径，为游戏产业的创新发展与合规治理提供理论支撑和实践参考。
