  • Abstract: The rapid development of artificial intelligence technology has resulted in a large number of excellent works in the art field. However, due to the lagging of law, there is still a lack of clear regulations on how to regulate them. In academia, there have been a certain number of articles discussing this issue in the past, but most of them focus on the legal nature of works generated by artificial intelligence. As artificial intelligence has been widely used in reality, it becomes more and more necessary to discuss and research how to qualitatively and determine the responsibility when it occurs similar to copyright infringement. This paper is based on maximizing social benefits, believing that artificial intelligence learning of others’ works should not be regarded as infringement, and guaranteeing the learning of artificial intelligence machines. According to the different types of infringement behavior of artificial intelligence products, the responsibility of users and developers is divided to promote market competition and provide more works for the society 目前人工智能技术迅速发展,在艺术领域人工智能亦产生了大量优秀作品,但由于法律的滞后性,对其应如何规范,目前仍缺少明确法规。在学界,过去已有一定数量的文章对此进行讨论,但多关注于人工智能所生成作品的法律性质等方面,而由于人工智能在现实中已被大量应用,关于当其发生类似于著作权侵权的行为时,应如何定性与确定责任的问题变得愈发需要探讨与研究。本文基于促进社会效益最大化的原则,认为人工智能学习他人作品不应被视为侵权,以保证人工智能机器学习的正常进行;并根据人工智能产品侵权行为的不同类型,区分使用者和开发者的责任,使人工智能促进市场竞争,为社会提供更多作品。
