Abstract:
The rapid development of generative artificial intelligence technology is profoundly reshaping the production relationships of content creation. The copyrightability issue of AIGC has become an urgent issue in the intellectual property field that needs to be addressed. Currently, academic circles are fiercely debating the theory of creative tools, the proto-creator theory, and the neighboring rights protection theory. In judicial practice, the trajectory shifts from negative to affirmative and then to cautious restraint. Based on a systematic review of theoretical lineages and judicial divergences, this paper deeply analyzes the internal dilemmas in determining AIGC copyrightability from three core dimensions: originality judgment, user control, and prompt qualitativeness, and critically reflects on the theoretical shortcomings of the “instrumental theory.” The study believes that the institutional bottom line of anthropocentrism should be upheld, establishing a standard of “minimum degree of creativity,” and building proof rules centered on “substantial contribution,” thereby achieving a dynamic balance between encouraging technological innovation and safeguarding the fundamental values of the copyright system.
生成式人工智能技术的迅猛发展正在深刻重塑内容创作的生产关系,AIGC的可版权性问题已成为知识产权领域亟待回应的时代命题。当前学理界围绕创作工具说、拟制作者说与邻接权保护说展开激烈争鸣,司法实践中则呈现出从否定立场到肯定态度,再到审慎限缩的摇摆轨迹。本文在系统梳理理论谱系与司法分歧的基础上,从独创性判断、用户控制性与提示词定性三个核心维度深入剖析AIGC可版权性认定的内在困境,并对“工具论”的学理缺陷进行批判性反思。研究认为,应当坚持人类中心主义的制度底线,确立“最低限度创造性”的判断标准,构建以“实质性贡献”为核心的举证规则,从而在激励技术创新与维护著作权制度基本价值之间实现动态平衡。
