后现代法学背景下人工智能的法哲学探析

• 摘要： 随着时代的高速发展与进步，产生了很多新鲜事物，一些问题的解决措施随之更新迭代。手机作为一种传播工具也做到各方面在一直升级，比如人脸识别、声纹识别等都在彰显着当今世界受人瞩目的研究领域——人工智能。人工智能的产生是科学技术与法律的结合，其产生后运用的领域非常广泛。而面对其广泛的运用空间则带来了很多法律上的问题，因此在学术界与实务界都引起了巨大的关注，人工智能的自身缺陷包括算法的绝对理智化等，其所带来的适用上的法律问题是本文探究的重点之一。当人工智能出现了一定的问题，此时人们渴求法律对其恰当规制的心情则会愈演愈烈，因此对于人工智能所产生的问题如何通过法律予以恰当规制同时也是本文论述的重点内容。后现代主义是一个新兴名词，其词源源于现代主义，而又是对现代主义不满才产生的。在后现代主义中，法学家们在一个全新的角度出发，展现出他们在崭新的角度上对于人工智能的见解，为人工智能所带来的法律问题贡献了自己的力量，因为他们的这些思考，人们沿着这种思维角度去考虑人工智能问题则有了更加全面的理解。对于人工智能，此前法学界所研究的热点问题——法哲学角度上人工智能的法律主体问题，该研究就是一个很好的例子。专业人士给予社会民众一些思考的路径以及良性的角度供他们参考，他们则会对人工智能的理解更加透彻。
• With the rapid development and progress of the times, many new things have been produced, and some problem solving measures have been updated and iterated. As a communication tool, mobile phones have also been upgraded in all aspects, such as face recognition, voiceprint recognition, etc., which are highlighting the research field of today’s world’s attention - artificial intelligence. The emergence of artificial intelligence is a combination of science and technology and law, and its application is very wide-ranging. In the face of its extensive application space, it has brought many legal problems, so it has attracted great attention in academia and practice, and the shortcomings of artificial intelligence include the absolute rationalization of algorithms, etc., and the legal problems brought about by it are one of the focuses of this paper. When there are certain problems in artificial intelligence, people’s desire for the law to properly regulate it will intensify, so how to properly regulate the problems caused by artificial intelligence through law is also the focus of this article. Postmodernism is a new term, whose etymology derives from modernism, and it is the result of dissatisfaction with modernism. In postmodernism, jurists have shown their views on artificial intelligence from a new perspective, contributing to the legal issues brought about by artificial intelligence, because of their thinking, people have a more comprehensive understanding of artificial intelligence issues along this thinking angle. For artificial intelligence, the research is a good example of the hot issue previously studied by the legal community - the legal subject of artificial intelligence from the perspective of legal philosophy. Professionals give the public some ways to think and benign angles for their reference, and they will have a more thorough understanding of artificial intelligence.
