• Abstract: This paper first examines the relationship between online public opinion and judicial adjudication, pointing out that online public opinion is not an independent system or mechanism separate from the law, but merely reflects the public’s attitude toward existing laws, regulations, and policies. Based on this, the author argues that judicial authorities should recognize the significant influence of online public opinion on judicial proceedings and take corresponding measures to address this phenomenon. Secondly, this paper conducts a comparative analysis of relevant cases in China and the United States to examine the differing manifestations and roles of online public opinion in the judicial processes of the two countries, thereby gaining a deeper understanding of the relationship between online public opinion and judicial fairness. Finally, this paper proposes a suggestion based on rational thinking: when the public feels strongly dissatisfied with the actions of a criminal suspect, they should be encouraged to express their grievances through legal channels to avoid engaging in extreme behavior; simultaneously, judicial authorities should also pay attention to such social public opinion, strengthen their review of related cases, and ensure that cases are handled fairly and justly. 本文首先考察了网络民意与司法审判的关系，指出网络舆论并非独立于法律之外的另一种制度和机制，而只是反映公众对现行法律、法规和政策的态度。基于此，作者认为司法机关应当认识到网络民意对司法审判的重要影响，并采取相应措施应对这一现象。其次，本文通过比较研究中美两国的相关案例，分析网络民意在两国司法过程中的不同表现和作用，从而进一步了解网络民意与司法公正之间的关系。最后，本文从理性思考出发提出建议：当民众因犯罪嫌疑人的行为产生强烈不满情绪时，应鼓励其通过合法途径表达诉求，避免做出过激的行为；同时，司法机关也应该关注这些社会舆论，加强对相关案件的审理工作，确保案件能够得到公平公正的处理。
