• Abstract: In judicial practice, there are significant differences among different courts in the identification of “consensus”, “daily family life” and “joint life, joint production and operation”. These differences lead to inconsistencies in judicial adjudication standards and also reflect the variations in the value orientations of different courts during the adjudication process. By sorting out the value orientations of adjudicators from existing cases, this paper analyzes the consensusbased joint debts, daily family affair-based joint debts, and life & production-based joint debts respectively, and further concludes the corresponding basis and methods for identification. 在司法实践中，不同法院对于“合意”“家庭日常生活”“共同生活、共同生产经营”的认定存在较大差异，致使法院裁判尺度不一，也体现出不同法院在裁判时的价值取向的差异。在既有案例中梳理裁判者的价值取向，分别对合意型共债、日常家事型共债及生活生产型共债进行分析，进而得出相应的认定依据与方式。
