Abstract:
The widespread and routine nature of human-induced risks in modern society has made crimes of negligence a focal point in both criminal law theory and judicial practice. Influenced by Criminal Trial Reference No. 1079, cases involving the death of individuals with special physical conditions resulting from minor violence are frequently classified as the crime of negligent homicide in judicial practice. However, this paper observes that in some judicial rulings on such cases, the reasoning tends to focus more on the victim’s death and the perpetrator’s state of mind, whilst the examination of the act itself is relatively insufficient. In academic circles, some scholars recognize that examining the actus reus of minor acts of violence is a prerequisite for the legal characterization of such cases. This paper takes the identification of the actus reus in negligence offenses as its starting point. Drawing on specific case studies, it analyzes whether acts of minor violence constitute a violation of the objective duty of care and whether such acts constitute the actus reus of the crime of involuntary manslaughter in these cases.
人为风险在现代社会普遍化、日常化,使过失犯罪逐渐成为刑法理论研究和司法实践的重点议题。在《刑事审判参考》第1079号案例的影响下,司法实践中关于轻微暴力致特殊体质者死亡的案件多被定性为过失致人死亡罪。但本文观察发现,在部分此类案件的司法裁判中,裁判理由较为侧重于被害人的死亡结果与行为人的主观状态,而对实行行为本身的审查相对不足。在理论界,有学者认识到对轻微暴力行为实行性的考察是该类案件定性的前置性问题。本文以过失犯实行行为的识别为切入点,结合具体案例,分析轻微暴力行为是否属于违反客观注意义务的行为,以及该类案件中是否存在过失致人死亡罪的实行行为。
