Abstract:
Since the 1999 “Tian Yong Case” established that universities may serve as defendants in administrative litigation, the number of education-related administrative lawsuits has steadily increased. In adjudicating such cases, courts generally respect university academic autonomy and tend to focus their review on whether the procedures underlying administrative decisions are lawful. This paper takes cases involving degree conferment disputes in universities in Shanghai as research samples and employs an empirical research method to analyze judicial review of the principle of due process in such disputes. The analysis shows that the key factor influencing the outcome of educational administrative litigation is whether the procedure is proper and lawful. Through empirical research, this paper aims to systematically examine the current application of the principle of due process in university-related educational administrative litigation, with a view to providing references for both theoretical discussion and institutional improvement.
1999年“田永诉案”确立高校可以作为行政诉讼被告之后,教育行政诉讼案件日益增多,法院在审理这类案件时普遍尊重高校学术自治,大多把审查重心放在行政决定程序是否合法的问题上。本文以上海市高校学位授予纠纷案例为分析样本,采用实证研究方法,分析法院在审理学位授予纠纷案件时对正当程序原则的审查。分析表明,影响教育行政诉讼裁判结果的关键因素就是程序的正当与否。本文旨在通过实证研究,系统考察正当程序原则在高校教育行政诉讼中的适用现状,以期为学理探讨与制度完善提供参考。
