学术史视域下的法律翻译功能主义进路探析

• 摘要： 法律翻译功能主义理论对国内外法律翻译理论研究都有很大影响。目前学术界对法律翻译功能主义的研究比较碎片化，系统研究其发展进路的文献并不多见。本文从学术史的视角探究法律翻译功能主义发展脉络和进路，在一定程度上拓展了法律翻译功能主义的研究维度。研究发现，法律翻译功能主义不仅受德国翻译功能主义影响，而且借鉴融合了比较法功能主义研究方法。尽管法律翻译功能主义理论能够在很大程度上解决法律翻译实践中的具体问题，但功能主义自身也有一定的局限性。
• The functional approach to legal translation has had a great influence on the research of legal translation theory at home and abroad. The current academic research on functional approach to legal translation is fragmented, and there is few literature that systematically studies its development. This paper studies functional approach to legal translation from the perspective of academic history, which to some extent expands the research dimension of functional approach to legal translation. It is found that the functional approach to legal translation is not only influenced by German functionalism, but also learns and integrates the functional method of comparative law. Although this functional approach can largely solve the problems in legal translation practice, it has certain limitations in its own right.
