法经济学理论融入“电子商务法律法规”课程教学路径研究

  • Abstract: In the context of the deepening development of the digital economy, “E-Commerce Laws and Regulations”, as an emerging interdisciplinary course integrating law and economics, plays a crucial role in cultivating interdisciplinary legal talents. However, the increasingly prominent fragmentation between law and economics contents in current teaching has become a core bottleneck restricting teaching effectiveness. This issue confines students to superficial learning, making it difficult for them to grasp the deep connections between legal rules and e-commerce business decisions. Ultimately, they fall into the trap of mechanical memorization, failing to develop comprehensive analytical abilities that combine legal application with economic logic, and thus cannot meet the demands of the digital economy. Guided by the efficiency standard, the theory of law and economics constructs a comprehensive system supported by progressively linked concepts such as the Coase Theorem, cost-benefit analysis, social cost theory, and incentive compatibility design. This system provides a systematic integration framework and methodological tools to solve the fragmentation problem in e-commerce law teaching. Based on the core perspective of law and economics and the specific attributes of the course, this paper explores specific paths to fundamentally resolve this fragmentation through theoretical framework reconstruction, deep integration of teaching content, and innovation in teaching methods. The goal is to guide students in establishing integrated legal and economic analytical thinking, cultivating their comprehensive analytical and practical application abilities, and supplying the digital economy era with interdisciplinary legal talents equipped with both solid legal expertise and economic analytical perspectives, thereby facilitating the legalized and standardized development of the e-commerce industry. 在数字经济深化发展的背景下,“电子商务法律法规”作为法学与经济学交叉融合的新兴课程,其教学质量直接关系到复合型法律人才的培养成效[1]。当前课程教学中法学与经济学内容割裂的问题愈发突出,已成为制约教学效果提升的核心瓶颈[2]。这一问题直接导致学生在学习过程中停留在表层形式,难以理解法律规则与电子商务商业决策之间的深层内在联系,最终陷入机械记忆法律条文的学习误区,无法形成兼具法律适用思维与经济逻辑思维的综合分析能力,难以适应数字经济发展对复合型法律人才的需求[3]。法经济学理论以效率标准为核心价值导向,构建起由科斯定理、成本收益分析、社会成本理论及激励相容设计等理论相互支撑、层层递进的完整理论体系,为破解电子商务法教学的内容割裂难题提供了系统化的整合框架与方法论工具。本文从法经济学理论的核心视角出发,结合“电子商务法律法规”的课程属性与教学特点,深入探讨如何通过理论框架重构、教学内容深度整合和教学方法创新等具体路径,从根本上解决电子商务法教学中的内容割裂问题,引导学生建立法律与经济相融合的分析思维,培养综合分析能力与实践应用能力,为数字经济时代输送既掌握扎实法律专业知识,又具备经济学分析视野的复合型法律人才,助力电子商务行业的法治化、规范化发展[4]。
